Our Contract

Kindly go through the below mentioned set of Terms & Conditions upon which we, Farnells Executive Hire, will provide you our services. We request you to read the terms & conditions carefully and please make sure they are clear to you. By using our service to book a vehicle hire for yourself, you agree to be bound by these Terms & Conditions. If there are any Terms you do not understand, please do not hesitate to contact us and we will happy to explain it to you. However, if you do not agree with our Terms & Conditions then please abstain from using our website, or from proceeding with your proposed booking.

Our Services

Farnells Executive Hire will provide you a limousine, luxury car or wedding car hire service which means we will arrange on your behalf the hire of one of the models of vehicles and the associated vehicle hire services displayed on our Site from one of the United Kingdom vehicle hire operator(s) with whom we work, to any destination in the United Kingdom on your chosen time and date(s).

We undertake the responsibility to arrange the chosen vehicle by you for hire. When we provide our services we act as agent for the Operators to promote and sell the hire of the models of vehicles owned by the Operators and displayed on our site. Once you make the booking through us you have legally entered into an agreement to hire the vehicle and services associated with it as described in your booking confirmation.

You are required to produce true and accurate information about yourself in order to enable us to arrange the Vehicle Hire. This information will be used to provide you with quotation. Make sure that the information provided by you is correct and we do not accept any liability if the booking is cancelled because of incorrect information provided by you. However, if you feel there is a mistake in the booking then kindly contact us to get it rectified. We will take all the necessary steps to clear this confusion.

The hire of a particular vehicle is subject to availability. Receipt of your booking request will not imply that your order has been accepted. Once your booking is accepted a contract will come into existence between you and the Operator for the supply of the Vehicle Hire Services. Please note that at this time you will be bound by the Operator Terms and may only cancel the Vehicle Hire Services in accordance with the Terms.

Kindly note, we have the rights to cancel your booking at any stage if we suspect that you used fraudulent means for booking. The images of the vehicles displayed on our site are for illustrative purposes only. The vehicle hired may not be exactly as displayed on our Site. The vehicle hired may vary slightly from the vehicle displayed on our Site but it will confer the specification set out in your Booking Confirmation.

Your responsibilities

If you are booking the vehicle, you will need to confirm that you are at least 18 years old. You are required to provide your full name with date of birth to us while making the booking. If your details are found out to be wrong you will be held responsible for it.

If you are not the hirer, you will have to confirm that you have the authority to bind with the business on whose behalf you are making the booking to avail our vehicle hire service.

In case you are making the booking on behalf of a group, you will need to accept these terms and conditions on the behalf of your group. You will ensure that all members of your group comply with these terms. You will be held accountable if any loss or damage is caused to the vehicle or if there is failure to comply with the terms and conditions.

It is your responsibility to notify us of any changes in address or contact details after the acceptance of your booking.

You need to agree with any restrictions placed to the Vehicle Hire Services including but not limited to the number of passengers.

You will be picked from the designated pick-up address provided by when you booked/reserved the vehicle. In case you fail to be available at the designated pick-up address on designated time, you will be liable to pay full charge for the vehicle hire service.

When you accept the agreement it means you comply with our terms and give permission to the operator to refuse the vehicle hire service and to eject you or your fellow passengers from the vehicle in case there is improper conduct.

Changes to your Booking

Request for any changes to the booking schedule must be sent to us via email and your request can be submitted any time with in 7 calendar days before the date of hire but you must contact the operator directly.

There might be an additional charge for the change of booking payable to the operator. Revised charges will be notified to you via email and by phone from our side. However, if we are unable to arrange for the requested changes or if you don’t agree with the additional charges, then you may cancel your booking as per the cancellation policy under the operator’s terms. Please note if you cancel your booking you may be liable to pay the full hire charges to the Operator.

In addition to the additional charges which may be payable to the Operator in case of changes to the booking, Farnells Executive Hire will charge you the administration charges to cope up with the change to your booking:-

  • Change of name – £10.00
  • Change of designated pick up point (Same Town) – £15.00
  • Change of destination address – £15.00
  • Change of date of hire – £10.00
  • Change of return date – £10.00
  • Change of pick up time (same day) – £10.00
  • Change of drop-off time (same day) – £10.00
  • Change of pick-up date and time (alternative day) – £20.00
  • Change of return date and time (alternative day) – £20.00
  • Change in number of passengers – £15.00
  • Change in number of passengers and vehicle type booked (resulting in upgrade to vehicle size/specification – £20.00
  • Change in number of passengers and vehicle type booked (resulting in downgrade to vehicle size/specification – £20.00
  • Change to vehicle type (upgrade vehicle size/specification) – £20.00
  • Change to vehicle type (downgrade vehicle size/specification) – £20.00

These administration charges are payable at the time when you request for the change in your booking. These charges are exclusive of VAT which will be added at the applicable rate at the time.

Service Charges and Payment

In exchange for the provision of our services, there is a booking fee that will be charged as a booking confirmation which is your deposit. It is a non-refundable fee and is in addition to the charges for the vehicle hire charge. The Hire Charges are payable direct to the Operator on or before the date of hire in accordance with the Operator Terms.

The Booking Fee is payable directly to Farnells Executive Hire for confirming your booking.

You can pay the Booking Fee using a debit or credit card. However, we do not accept American Express or Diners Card.

You confirm that when you make the payment you are the card holder.

If your payment is not made by the due date, you might incur interest on the due amount. This interest will be applicable on a daily basis from the due date to the date of actual payment (that is the overdue amount) been received by us.

In case of a problem with the Service

In case you have any complaints about our service then please get in touch with us with your grievances. However, if your complaint is related to the provision of the Vehicle Hire Services your complaint should be made directly to the Operator. If your complaint is received by us and it relates to the Vehicle Hire Services we will forward the same to the Operator who will contact you direct.

Our liability to you

If we fail to comply with these Terms and Conditions or we are responsible for loss or damage you suffer that is because of a foreseeable result of our breach of the terms or our negligence but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if they were an obvious consequence of our breach or if they were contemplated by you and us at the time we entered into this contract.

We will under no circumstances be liable to you for any loss of profit, loss of business, business interruption, loss of business opportunity, loss of goodwill or loss of sales, business or revenue.

Our total liability to you in respect of all losses arising under or in connection with this contract shall in no circumstances exceed the Booking Fee.

Nothing in these terms limits or excludes in any way our liability for death or personal injury caused by our negligence or the negligence of our employees, fraud or fraudulent misrepresentation or where it would be illegal for us to exclude or limit our liability.

Events outside Our Control

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by an Event outside Our Control.

An Event Outside Our Control means any act or event beyond our reasonable control including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks, congestion, accident or criminal activity.

If an Event outside Our Control takes place that affects the performance of our obligations under these Terms:

(a)We will contact you as soon as reasonably possible to inform you; and

(b)Our obligations under these Terms will be suspended and the time for performance of our obligations will be extended for the duration of the Event outside Our Control. Where the Event outside Our Control affects our performance of Services to you, we will restart the Services as soon as reasonably possible after the Event outside Our Control is over.

How we may use your personal information

We will use the personal information given by you to:

(a) provide you the Services;

(b) process your payment for those Services; and

(c) provide you updates about our services (but you can opt out at anytime you want)

You agree that we may pass your personal information to an Operator to enable the Operator to provide the Vehicle Hire Services or to credit reference agencies and those agencies may keep a record of any search that they do.

We will not share your personal data with any other third party.

Other important terms

Under these Terms we may transfer our rights and obligations to another organisation, but we will always notify you via email and phone in case this happens. This will not affect your rights or our obligations under these Terms.

You may only transfer your rights or your obligations under these Terms to another person if we agree in writing.

This contract is between you and us and no other person have any rights to enforce any of its terms.

These Terms may vary from time to time to make changes as to how we accept payment from you, to reflect changes in relevant laws and regulatory requirements or to improve the manner in which we provide our Services. If the vehicle hire is cancelled within 30 days of the hire date you will be liable to pay the full balance due to the operator and will lose your booking fee. If the cancellation occurs more than 30 days before the vehicle hire then only the booking fee will be lost, any advance payment made to operator will also be refunded if it is made within this timeframe. If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.

In order to contact us in writing you can drop us an email or send a pre-paid post to the registered office address given above. In case we have to contact you or give you notice in writing, we will do so by e-mail, by hand, or by pre-paid post to the address you provide to us at the time of making your booking.

These Terms are governed by English and Welsh law. Both parties agree to submit to the non-exclusive jurisdiction of the English and Welsh courts.
